Japan releases Guam buildup Environmental Impact Statement

The central government of Japan has produced a crucial study on the plan to relocate the Marine Corps Air Station Futenma, which is «an important step» toward the military buildup on Guam, said Delegate Madeleine Bordallo.

Bordallo said Japan’s final Environmental Impact Statement is «concrete progress» toward relocating the much-debated facility. The shift of Futenma is a linchpin in the plan to bring Marines and their dependents to Guam.

«These steps by the Japanese government are important to showing their efforts to resolve political impasses in Okinawa, and this important action builds on Prime Minister Noda’s commitment to achieving ‘tangible progress’ on a Futenma Replacement Facility,» Bordallo said.

Blocked attempt

According to an article by Japan’s Kyodo news service, the Japan Defense Ministry delivered the EIS to the Okinawa Prefectural Government early Wednesday after its first attempt was blocked by angry residents.

Okinawa Gov. Hirokazu Nakaima, who has been a vocal opponent to the Futenma relocation plan, told Kyodo news that the prefecture has no choice but to receive the report now that it has been delivered.

Guam EIS

The EIS spans about 7,000 pages, which is similar to the Guam buildup EIS that was released last year. The Guam document included an extensive buildup plan and expectations of its impact on day-to-day life. The public was given months to scrutinize the document before the plan was made final in a Record of Decision.

Opposition

Nakaima and some Okinawa residents oppose the Futenma relocation plan because it moves some of the Marine aircraft within their island.

Although about 8,000 Marines would come to Guam, Marine air operations would shift to an expanded base at Camp Schwab, a base farther north in Okinawa.

Nakaima has said that the Marine Corps Air Station Futenma should be moved off of Okinawa entirely, to some other alternative location in Japan.

Sen. Judith Guthertz, chairwoman of the Legislature’s committee on the buildup, said the release of the EIS document is a «hopeful sign.

Guam – «We Are Guhan» spokesman Leevin Camacho issued the following statement in reaction to Judge Kobayashi’s decision to dismiss the Pagat lawsuit.

On December 30, 2011, Judge Leslie E. Kobayashi issued a "minute order" in the lawsuit to save Pågat Village stating that the case was now "moot" or "completed."  The decision comes after the Department of Defense ("DOD" filed a declaration by JGPO Executive Director Joseph Ludovici with the court on November 15, 2011 stating that DOD would prepare a Supplemental Environmental Impact Statement to "re-evaluate live-fire training range complex alternatives . . . . "  Based on DOD's concession to the plaintiffs’ request for the preparation of a Supplemental EIS that remedied the "deficiencies of the FEIS," the court dismissed the case.

"We wanted the court to continue to oversee the process," said Attorney Leevin T. Camacho, member of We Are Guåhan in response to the court's minute order, "but we are hopeful that DOD will live up to its legal obligations this time and ensure that the Supplemental EIS process is open and honest without the need for court intervention. "

The DOD filing stated that it would formally commence the Supplemental EIS process in 2012 by holding scoping meetings before preparing and releasing a Draft Supplemental EIS for comment.  This level of public involvement and participation ­is something that DOD had previously refused to agree to in its Motion for Voluntary Remand filed earlier in 2011.  

"Our goal from day one has been to ensure that DOD followed the law," said Camacho.  "The preparation of a Supplemental EIS is the first victory – a necessary victory – along the way to achieve our ultimate goal of saving Pågat Village. "

Judge Kobayashi’s minute order stated that a more detailed written order would follow.

Western Potash Files Updated Technical Report on SEDAR, Advances EIS, and Updates the Measured Indicated and Inferred …

VANCOUVER, British Columbia–(BUSINESS WIRE–
Western Potash Corp. (the "Company" (TSX: WPX, FSE: AHE is
pleased to announce the receipt of an updated NI 43-101 Technical Report
titled "NI 43-101 Technical Report Summarizing the Preliminary
Feasibility Study for a Potash Solution Mine on the Milestone Project
(Subsurface Mineral Lease KLSA 008, Saskatchewan." The Company confirms
that this Report has been filed on SEDAR on December 15, 2011. The
Technical Report includes an updated resource estimate, and a summary of
the Company's Pre-Feasibility Study announced via news release dated
October 31, 2011. The Prefeasibility Study (the "Study" was completed
by AMEC Americas Limited ("AMEC". AMEC is a leading international
engineering and project management company that currently manages
multiple potash expansion projects in Saskatchewan with a capital value
of several billion dollars.

The updated resource estimate slightly increases the Milestone
recoverable Potash Resource (Patience Lake, Belle Plaine, and Esterhazy
Members including the upper halite interbed to 66.6 million tonnes of
Measured Resource (contained KCl, 186.9 million tonnes of Indicated
Resource, and 708.2 million tones of Inferred Resource. Inferred
Resource around the Milestone Project plant site land and associated
infrastructure have been removed from the estimate. Purchase of the
plant site land was announced via news release dated June 21, 2011.
Mineral Reserves were not reported within this updated Technical Report.
Mineral reserves have not been estimated because the Company is
negotiating to obtain mineral leases for all the Freehold mineral rights
within the Indicated and Measured resource areas. These negotiations are
expected to be completed within the next few months. Mineral reserves
will be presented when acquisition of these mineral leases is
substantially complete. The updated resource estimate at Milestone was
prepared by Agapito Associates Inc. ("AAI" of Grand Junction, Colorado.
The Qualified persons for the Resource Estimate were Dr. Michael P.
Hardy, P.E (US, P.Eng. (SK, P.G. (US, and Dr. Douglas F. Hambley,
P.E. (US, P.Eng. (SK, P.G. (US.

A detailed summary of the Measured, Indicated and Inferred Mineral
Resource within Crown and Leased Freehold Areas is presented in Table 1,

AAI have made estimates of the Measured, Indicated and Inferred Mineral
Resources based on a Radius of Influence (ROI similar to that applied
by mine operators and peer group explorers working on solution mining
properties in the region. Furthermore, the Measured, Indicated, and
Inferred Mineral Resources were arrived at by discounting the overall
calculated tonnage by Loss Factors of 5%, 9% and 25% respectively, to
account for unknown geologic anomalies. The resulting potash quantity
was further reduced using an extraction ratio factor of 34.6%, which is
the estimated potash available to be extracted for the life of an
envisioned operation leaving sufficient material to support cavern
stability. The resource estimate was prepared in accordance with the
requirements of NI 43-101 of the Canadian securities regulators.

The recently completed Prefeasibility Study confirms that the Milestone
Project shows significant positive economics and that the asset is of
sufficient size and grade to support primary and secondary solution
mining for more than forty years at a production rate of 2.8Mt/yr. The
study concluded that there are no known limitations that may prevent a
successful and profitable project outcome. The Feasibility Study is in
progress, and will produce results which adhere to the AACE "Class 3"
classification for projects. Water sources are currently being evaluated
for the project.

Mineral resources that are not mineral reserves do not have demonstrated
economic viability.

The Company also reports that all environmental baseline data required
for the preparation of the EIS has now been collected. On October 11,
2011, the Company submitted a «Project Proposal» to the Saskatchewan
Ministry of Environment. The Project Proposal provides a conceptual
level description of the Milestone Project and formally initiates the
regulatory review process under the provincial Environmental Assessment
Act. Upon review of the Project Proposal, the government of Saskatchewan
will issue Project Specific Guidelines, which provide detailed
information requirements to be included in the EIS. The EIS remains on
schedule and on budget, with an anticipated EIS submission date of Q3
2012. Golder Associates Ltd. ("Golder" of Saskatoon, Saskatchewan
continues to assist the Company with the preparation of the
Environmental Impact Statement ("EIS" for the Milestone project. Golder
is an employee-owned, global company providing consulting, design, and
construction services in earth, environment, and related areas of
energy. Golder was chosen by the Company due to their commitment to
technical excellence and their experience with environmental assessments
for potash projects.

The 100% owned Milestone property, comprising 500 square kilometers, is
located 30 kilometers southeast of Regina, and southeast of Mosaic's
Belle Plaine Mine, one of the largest producing potash solution mines in
the world.

On July 28 2008, the Company signed an agreement with Amarillo Gold
Corporation (Amarillo", a company related by a common director, to
acquire potash mineral rights in Brazil. Amarillo, through its Brazilian
subsidiary, submitted applications on behalf of the Company for 113
potash permits totaling 982,962 hectares within potash prospective
portions of the Brazilian Amazon Basin. The Company is pleased to
announce that these permits have now been granted by the Brazilian
government. These potash permits are currently being transferred into
the Company's wholly owned Brazilian subsidiary, Potássio Ocidental
Mineração Ltd. (the "Subsidiary". The Subsidiary has also, since its

Klamath dams: County’s comments in

Siskiyou County recently submitted its comments for the Department of Interior's (DOI Draft Environmental Impact Statement/Report (EIS/EIR for Klamath Facilities Removal, as the Dec. 30 deadline for submissions approaches.
In addition to county government, the cities of Yreka, Dorris, Etna, Montague and Weed along with the town of Fort Jones passed resolutions stating their official support for the county's comments.
The 130-page document, prepared by County Counsel Tom Guarino and environmental attorney George Mannina Jr. of Nossaman LLP, outlines a long list of criticisms against the EIS/EIR. The majority of the criticisms are based on the county's allegation that scientific analysis throughout the EIS/EIR is either not sufficient to meet legal requirements of the National Environmental Policy Act (NEPA and the California Environmental Quality Act (CEQA, or that claims about environmental benefits of dam removal contradict the findings of DOI's expert panels.
The over-riding allegation of the document is summarized on page 121 in the "Conclusion" section.
"NEPA and CEQA require that there be a 'hard look' at the environmental effects of a proposed action .. . this hard look 'must be taken objectively and in good faith, not as an exercise in form over substance, and not as a subterfuge designed to rationalize a decision already made' … For all intents and purposes, the EIS/EIR appears to be 'a subterfuge designed to rationalize a decision already made,'" the document states.
Throughout the DOI's Secretarial Determination process, the county has maintained the allegation that dam removal is a foregone conclusion and the scientific analysis has been biased to support that conclusion.
The "Conclusion" section of the county's document contains 35 bulleted points intended to support this claim.
Among the allegations of scientific misconduct and failure to meet legally required standards of analysis are the following:
• "The EIS/EIR states the proposed action (dam removal is to advance the restoration of salmonid fisheries." The county feels that the findings of the DOI's expert panels indicate that benefits would be "small," "remotely possible," "uncertain," "unlikely" and "not feasible. "
• "The EIS/EIR examines the effects of the proposed action on fish as if each individual species is the only occupant of the ecosystem." The county alleges that the EIS/EIR fails to analyze effects of changes in species interactions.
• "An expert panel found that the EIS/EIR's reliance on average daily mean temperatures to measure the temperature impacts of dam removal on fish was incorrect. Fish do not experience average temperatures. Fish experience hour-by-hour temperatures."
• "The EIS/EIR admits the proposed action will increase nutrient loads … algae growth … pH levels … and disease … and, therefore, make water quality worse."
• "… in at least four places the EIS/EIR states it need not examine the effects of dam removal on estuarine habitat … In an equal number of places, the EIS/EIR says sediment will reach the estuary. Both assertions cannot be right."
• "The EIS/EIR admits that dioxin and other chemicals are present in dangerous levels behind J.C. Boyle Dam. There is no analysis of the likely adverse impacts of these pollutants. Instead, the EIS/EIR says these hazardous pollutants will be diluted when the three dams below J.C. Boyle Dam are removed. "
• "There is no analysis of the effects of reduced revenues on the County's ability to serve its citizens."
• "The EIR/EIS contains no analysis of the impact of increased energy costs on the citizens of Siskiyou County or of the environmental effects of replacing clean hydropower with other energy sources."
• "The EIS/EIR is devoid of any discussion of how the proposed action proposes to comply with the applicable ordinances of Siskiyou County."
The county's comment document concludes by stating, "The EIS/EIR meets neither the spirit nor the letter of the law. A revised EIS/EIR must be prepared to address these deficiencies. Thundering Herd women slip past Ball State, 60-58

MUNCIE, Ind. — The Marshall women’s basketball team connected on key free throws in the closing minutes and celebrated New Year’s Eve with a 60-58 victory over Ball State on Saturday at Worthen Arena.

Jasmine Shaw led the Thundering Herd (9-3 with 12 points. Victoria Wells added 11 and Alyse Poindexter 10. Erica Woods had one of the best games of the year on the boards, recording a career-high 14 rebounds. She got nine on the offensive glass and 10 overall in the first half.

«It was a mental toughness win for us,» Marshall coach Royce Chadwick said. «It was a very gritty performance by a team that decided to lock it down in the last five minutes. The defense was spectacular in the last five minutes. Players stepped into roles when they needed to and made spectacular plays when they need to especially on defense.»

Rashedah Henriques converted a put-back lay-up with 4:00 left to put Marshall ahead, 51-50. From there, the Cardinals (5-8 had to foul and the Herd made seven free throws in the final minutes to hang on.

Jazmin Hitchens led the Cardinals with 17 points and seven rebounds. Shanee’ Jackson chipped in with 12 points.

Ball State built a 9-point lead (50-41 thanks to two jumpers from Mercedes Miller, but Marshall responded with a 10-0 run to regain control. The game was tied again at 54-54 with 1:44 left, then the Herd scored four of the next five points.

The game was the second half of a men’s-women’s doubleheader. In the men’s game, Ball State beat Chicago State, 86-58.

Marshall will open Conference USA play Thursday at Houston.
